Decree of the President of the Republic of Azerbaijan on Establishment of the Coordinating Council of the Republic of Azerbaijan on Transit Freight:

 

A number of large-scale projects aimed at increasing the transit potential of the Republic of Azerbaijan have been implemented in recent years. Thus, the biggest port in Caspian basin, Baku International Sea Trade Port and Baku Shipyard have started to operate, reconstruction of Baku-Boyuk Kesik railway and construction of Baku-Tbilisi-Kars railway line are being realized.

Construction of several international airports, purchase of new aircrafts and vessels, establishment of modern highways network played an important role in strengthening of the country’s transport infrastructure and expanded the opportunities for participation in transit transportation.

In addition to the projects carried out in the country's transport sector, it is important to increase the competitiveness and efficiency of transit corridors passing through the territory of the Republic of Azerbaijan, to take a number of measures to attract additional transit cargo flows to the corridors, including improvement of the quality of freight, cargo delivery process and reduction of costs.

Guided by Paragraph 32 of the Article 109 of the Constitution of the Republic of Azerbaijan, to implement a common, flexible and transparent tariff policy in the field of transit cargo transportation carried out via railways, marine transport, marine ports and marine terminals in the Republic of Azerbaijan, to simplify border crossing procedures and handling processes, as well as to ensure the coordination of works among state bodies acting in this field I hereby decide:

1. To create the Coordinating Council of the Republic of Azerbaijan on Transit Freight.

2. To approve "Charter of the Coordinating Council of the Republic of Azerbaijan on Transit Freight" (attached).

3. To approve "Composition of the Coordinating Council of the Republic of Azerbaijan on Transit Freight" (attached).

4. To apply "one stop shop" principle in transportation of transit cargo through the territory of the Republic of Azerbaijan via railways, marine transport, marine ports and marine terminals.

5. To entrust to the Coordinating Council of the Republic of Azerbaijan on Transit Freight implementation of single state body authority regarding application of "one stop shop" principle for transportation of transit cargo passing through the territory of the Republic of Azerbaijan via railways, marine transport, marine ports and marine terminals.

6. Cabinet of Ministers of the Republic of Azerbaijan:

6.1. To prepare proposals related to the conformity of acts of the President of the Republic of Azerbaijan to this Decree and submit them to the President of the Republic of Azerbaijan within three months;

6.2. To provide the conformity of the normative legal acts of the Cabinet of Ministers of the Republic of Azerbaijan to this Decree within three months and inform the President of the Republic of Azerbaijan;

6.3. To supervise the conformity of the normative legal acts of the central executive bodies to this Decree and inform the President of the Republic of Azerbaijan on implementation within five-month period;

6.4. To solve other issues arising from this Decree.

7.  The Ministry of Economy of the Republic of Azerbaijan:

7.1. To prepare within two months and submit to the President of the Republic of Azerbaijan tariffs and rules for defining of discounts for the services concerning transportation of transit cargo by railways and sea transport, exploitation of port facilities for transit cargo, handling and other services provided in a port.

7.2. Together with the Coordinating Council of the Republic of Azerbaijan  on Transit Freight ensure the creation of an electronic portal reflecting a common tariffs for the transportation of the transit cargo via railways, marine transport, marine ports and marine terminals of the country, border crossing procedures, terms and conditions on cargo transportation, terms and rules for conclusion of contracts, acceptance of electronic applications concerning administrative procedures during crossing of state border of the Republic of Azerbaijan, opportunities for conclusion cargo transportation contracts electronically, cargo tracking and other issues.

8. Ministry of Justice of the Republic of Azerbaijan to provide the conformity of the normative legal acts and normative acts of the central executive bodies to this Decree and inform the Cabinet of Ministers of the Republic of Azerbaijan.

9. It shall be determined that organization of the current activity of the Coordinating Council of the Republic of Azerbaijan on Transit Freight is performed by the Secretariat of the Tariff (price) Council of the Republic of Azerbaijan.

10. The Coordinating Council of the Republic of Azerbaijan on Transit Freight shall provide information to the President of the Republic of Azerbaijan twice a year on works carried out in the field of the transportation of transit cargo in the Republic of Azerbaijan via railways, marine transport, marine ports and marine terminals.
